TRABALHO INFANTIL PERIGOSO: VIOLAÇÃO À SAÚDE E CONSEQUÊNCIAS JURÍDICO-SOCIAIS.

De 1964 a 1985 o Brasil viveu sob um regime de governo ditatorial que de acordo com a historiografia mais recente foi sustentado, em grande parte, pela própria sociedade civil (MELO, 2012; COMISSÃO, 2014). Mais recentemente, a partir dos anos 1980, cresce o movimento de criação de espaços de memória corporativos com o objetivo de tornar pública a trajetória histórica das empresas (COSTA; SARAIVA, 2011). Dentre estes espaços, adquire relevância os Centros de Memória e documentação como lugares de (...) armazenamento e lembrança de memória organizacional, que ajudam a construir simbolicamente a imagem organizacional e a fornecer um senso de coerência e trajetória linear (RIBEIRO; BARBOSA, 2007). Neste contexto, e com base na documentação disponibilizada pela Comissão Nacional da Verdade, a presente pesquisa tem por objetivo identificar como o Museu Histórico da Fundação Bradesco retrata (ou deixa de retratar) o relacionamento da empresa Bradesco com o governo brasileiro no período da ditadura civil-militar. More recently, since the 1980s, it is possible to be noticed the growing movement of creation of corporate memory spaces in order to make public the historical trajectory of the companies (COSTA and SARAIVA, 2011). Among these spaces, acquires relevance the Corporate Documentation and Memory Centers, which help to symbolically build the organizational image and to provide a sense of consistency and linear trajectory (RIBEIRO and BARBOSA, 2007). In this context, and based on documentation provided by the National Commission of Truth, this research aims to identify how the History Museum of Bradesco Foundation portrays (or does not portray) the relationship between Bradesco company and the Brazilian government in the period of civil-military dictatorship. Em sede de objetivo geral pretende-se elucidar a partir de teóricos decoloniais sobre o neoliberalismo, as justificativas desenvolvimentistas, respondendo a seguinte pergunta de pesquisa: em que medida a concepção neoliberalista, abarcadas pelo Estado Brasileiro, configurou a atmosfera de conflitos socioambientais que se apresenta na atualidade da Amazônia brasileira? O método utilizado é o exploratório-indutivo, com estudo bibliográfico. Como principais resultados, tem-se na literatura de pesquisa da Amazônia sobre megaprojetos da (COSTA,2012; ACEVEDO MARÍN, 2017; Marin e Maia, 2018; LOUREIRO,2010;SILVA,2020, 2022) (...) a observância da deterioração das bases sociais nos territórios dos municípios afetados, e esta decorre da ausência de um planejamento mínimo para as pequenas cidades que sofrem com a migração, aumento brusco da população e ausência de infraestrutura mínima para a sobrevivência digna, alterando de forma negativa seu modo de vida. Aborda-se a prática interpretativa no Direito a partir da necessidade de um “acerto de contas” (accountability) do Direito com a Filosofia. A aplicação dos indícios formais como um método fenomenológico suficiente a valorizar o caso concreto e permitir o desvelamento do sentido das coisas aparece como alternativa. Busca-se um caminho teórico-filosófico alternativo consistente para guiar uma investigação interpretativa suficiente para o Direito. Toma-se como referencial teórico a Hermenêutica Ontológico-Existencial (Martin Heidegger e Hans-Georg Gadamer), à luz da filtragem da Crítica Hermenêutica (...) do Direito, de Lenio Streck, procurando assinalar a relevância da “situação hermenêutica” em todo ato interpretativo. Analisa as relações teóricas e empíricas entre os termos “Competência em Informação” e “Inclusão Digital”; “Competência Informacional” e “Inclusão Digital”; “Competência Crítica em Informação” e “Inclusão Digital”. De natureza básica, bibliográfica, documental, descritiva e análise de conteúdo. Para tanto, utiliza-se o método quali-quantitativo. Como resultado, afirma-se que, o principal desafio da CoInfo na conjuntura atual estar centrado nos processos de exclusão digital sistêmica em escala global, à medida que não há Sociedade da Informação sem consciência cidadã, bem como justiça epistêmica (...) na era digital. Portanto, afirmar-se que, a aquisição de CoInfo vai de encontro a apropriação oportunista dialética dos políticos, que, usam a inclusão digital como algo feito e acabado simplesmente pela doação e instalação de kits de computadores e acesso à internet no Brasil, nos últimos 23 anos de implantação da sociedade da informação. O presente artigo trata de abordar a temática da busca de identidade do profissional da Educação Infantil no Brasil, fazendo um contraponto com a concepção de Educação de Paulo Freire e com a concepção de “Direito à Educação”. Analisa a luta pela Educação Infantil efetivada pelos movimentos sociais e educacionais do país. Destaca a integração da Educação Infantil e as contradições de compreensão da reorganização da Escola e do espaço pedagógico em vista do protagonismo da Criança como sujeito de Direitos (...) e da Infância como tempo e identidade de formação humana. Este dossiê representa a continuidade de um projecto que tem procurado debater publi­camente o património dos agentes ligados à produção e circulação do livro. Centrando-se nos espólios dos livreiros, a introdução problematizante e os depoimentos procuram dis­cutir o seu carácter invisível enquanto objecto de pesquisa, salvaguarda e divulgação. Há, então, uma reflexão que urge fazer, à semelhança do que ocorre com o património dos edi­tores (arquivos históricos e não só), no sentido de reconhecer o estatuto patrimonial e histó­rico dos acervos (...) dos livreiros e das livrarias enquanto espaços fundamentais da construção da cultura impressa e da história do livro e da edição. Mas é também urgente conferir ao debate um cunho de acção e de cooperação inter-institucional que suscitem uma sensibili­dade política e o aparecimento de possibilidades concretas de salvamento, recolha e depó­sito sistemático de um dos mais fundamentais elementos da memória colectiva escrita. ABSTRACT This article aims to analyze, from a Bakhtinian perspective, the grotesque construction of Mexican artist Frida Kahlo’s body through a religious worldview. Therefore, we analyze two of her self-portraits, taking into account the dialogic relations constructed between the grotesque representations and Catholic symbology. The analyzed utterances, in which the specificities of the creative competence of the author-creator in her aesthetic activity are inferred, showed that a dialogue is established between the painting El venado herido and Catholic Saint Sebastian and (...) between the painting Las dos fridas and the image of the Sacred Heart of Jesus. IntroductionThere is a need to maintain rehabilitation activities and motivate movement and physical activity during quarantine in individuals with Cerebral Palsy.ObjectiveThis paper sets out to evaluate the feasibility and potential benefits of using computer serious game in a non-immersive virtual reality implemented and evaluated completely remotely in participants with CP for Home-Based Telerehabilitation during the quarantine period for COVID-19.MethodsUsing a cross-sectional design, a total of 44 individuals participated in this study between March and June 2020, 22 of which had CP (...) and 22 typically developing individuals, matched by age and sex to the individuals with CP. Participants practiced a coincident timing game1 and we measured movement performance and physical activity intensity using the rating of perceived exertion Borg scale.ResultsAll participants were able to engage with the VR therapy remotely, reported enjoying sessions, and improved performance in some practice moments. The most important result in this cross-sectional study was the significant increasing in rating of perceived exertion in both groups during practice and with CP presenting a higher rating of perceived exertion.ConclusionChildren with CP enjoyed participating, were able to perform at the same level as their peers on certain activities and increased both their performance and physical activity intensity when using the game, supporting the use of serious games for this group for home therapy and interactive games.Clinical Trials Registrationhttps://Clinicaltrials.gov, NCT04402034. Although science is our most reliable producer of knowledge, it can also be used to create ignorance, unjustified doubt, and misinformation. In doing so, agnotological practices result not only in epistemic harms but also in social ones. A way to prevent or minimise such harms is to impede these ignorance-producing practices. In this paper, I explore various challenges to such a proposal. I first argue that reliably identifying agnotological practices in a way that permits the prevention of relevant harms is (...) more difficult than it might appear. I focus on an identifying criterion that many find apt for the task: bad faith motives. I then consider an objection—that reliable criteria are unnecessary to successfully address the concerns raised by agnotological strategies—and I show that it fails. I conclude by exploring other ways of conceptualising the problems attributed to agnotological practices. In particular, I challenge the focus on misinformation as the main problem of concern. During emerging public health crises, both policymakers and members of the public are looking to scientific experts to provide guidance. Even in cases where there are significant uncertainties, there is pressure for experts to “speak with one voice” to avoid confusion, allow officials to make evidence-based decisions rapidly, and encourage public support for such decisions. This can lead experts to engage in masking of information about the state of the science or regarding assumptions involved in policy recommendations. Although experts might (...) have good reasons for masking disagreements, uncertainties, or assumptions when offering policy advice, we argue that this strategy can result in epistemic harms. Using the case of the COVID-19 pandemic, we show that public health authorities masked two types of information necessary for laypersons to evaluate public health recommendations: (1) experts’ disagreements about the scientific evidence and (2) the role of values in making inferences from the science to policy positions. We contend that this resulted in epistemic harms against laypeople that provide a pro tanto case against masking information. We further argue that when the science is in flux and policies need to be implemented despite significant uncertainties, there is an all-things-considered case against masking the types of information discussed. The argument from inductive risk has been embraced by many as a successful account of the role of values in science that challenges the value-free ideal. We argue that it is not obvious that the argument from inductive risk actually undermines the value-free ideal. This is because the inductive risk argument endorses an assumption held by proponents of the value-free ideal: that contextual values never play an appropriate role in determining evidence. The therapeutic misconception has been seen as presenting an ethical problem because failure to distinguish the aims of research participation from those receiving ordinary treatment may seriously undermine the informed consent of research subjects. Hence, most theoretical and empirical work on the problems of the therapeutic misconception has been directed to evaluate whether, and to what degree, this confusion invalidates the consent of subjects. We argue here that this focus on the understanding component of informed consent, while important, might be (...) too narrow to capture the ethical complexity of the therapeutic misconception. We show that concerns about misplaced trust and exploitation of such trust are also relevant, and ought to be taken into account, when considering why the therapeutic misconception matters ethically. Philosophers of science, particularly those working on science and values, often talk about the need for science to be socially responsible. However, what this means is not clear. In this paper, we review the contributions of philosophers of science to the debate over socially responsible science and explore the dimensions that a fruitful account of socially responsible science should address. Our review shows that offering a comprehensive account is difficult. We contend that broad calls for socially responsible science that fail (...) to attend to relevant dimensions are not the solution, as they preclude meaningful changes to research institutions and practices. We conclude that narrower, more explicit accounts are more likely to lead to substantive transformation. (shrink)

Deve-se prioritariamente reconhecer como consequência as violações de direitos humanos que são impostas aos grupos impactados pelos grandes empreendimentos que capturam os agentes públicos decisores dos processos (...) de licenciamento, beneficiando-se da ausência da consolidação normativa socioambiental. A new reprogenetic technology, mitochondrial replacement, is making its appearance and, unsurprisingly given its promise to wash off our earthly stains --or at least the scourges of sexual reproduction--, John Harris finds only reasons to celebrate this new scientific feat.1 In fact, he finds mitochondrial replacement techniques (MRTs) so “unreservedly welcome” that he believes those who reject them suffer from “a large degree of desperation and not a little callousness.”2 Believing myself to be neither desperate nor callous, but finding myself (...) also no closer at all – not even after reading his article—to following Harris in welcoming these technologies wholeheartedly, it seems appropriate to respond. Because of the important benefits that biomedical research offers to humans, some have argued that people have a general moral obligation to participate in research. Although the defense of such a putative moral duty has raised controversy, few scholars, on either side of the debate, have attended to the social context in which research takes place and where such an obligation will be discharged. By reflecting on the social context in which a presumed duty to participate in research will obtain, (...) this article shows that decontextualized discussions of this putative moral obligation are problematic. Many have argued that allowing and encouraging public avenues for dissent and critical evaluation of scientific research is a necessary condition for promoting the objectivity of scientific communities and advancing scientific knowledge . The history of science reveals many cases where an existing scientific consensus was later shown to be wrong . Dissent plays a crucial role in uncovering potential problems and limitations of consensus views. ABSTRACT Regarding an already consolidated tradition in discourse studies in Latin America, with featured importance in graduate programs in the field of Linguistics and a busy calendar of annual events in the field, it is possible to say that there is considerable amount of imported knowledge being applied and very little creativity in local theoretical or methodological production. Discourse studies are generally divided into two main schools of thought: French discourse analysis and English discourse analysis. The denomination that represents these (...) lines of discourse sheds light on the colonized nature of the field. This colonization of discourse knowledge, in more immediate terms, indicates considerable effort applied to theories viewed as universally valid and scarcely modified for the situated context, but it also shows the implications of being a discourse analyst in a subordinate space within the academic field – a place where we, Latin American discourse researchers, occupy compared to our colleagues in the global North – and about contemplating theoretical alternatives. The decolonizing effort of this field should thus be directed to three converging paths: decolonizing knowledge, in the sense of criticizing theories and methods while understanding that there is no universal knowledge; decolonizing the power of the creative act of overcoming this universalizing knowledge, which means accepting the force of local methodological and theoretical production, especially by constantly questioning disciplinary separation and its impositions; and decolonizing the being, making strategic use of this paradoxical space, which contains the possibilities of knowledge communion, also including common knowledge. All this should have an impact on graduate-level education in discursive studies, in a virtuous cycle between consciousness, criticism and creativity. (shrink)

Recently, some have proposed moral bioenhancement as a solution to the serious moral evils that humans face. Seemingly disillusioned with traditional methods of moral education, proponents of bioenhancement believe that we should pursue and apply biotechnological means to morally enhance human beings. Such proposal has generated a lively debate about the permissibility of moral bioenhancement. We argue here that such debate is specious. The claim that moral bioenhancement is a solution - whether permissible or not - to the serious moral (...) problems that affect human beings is based on several problematic framing assumptions. We evaluate here three of such assumptions: the first rests on a contested understanding of morality, the second consist in a mistaken conception of human moral problems, and the third relates to problematic presuppositions grounding the interpretation of existent scientific evidence presented to defend moral bioenhancement. Once these framing assumptions are identified and critically evaluated, it becomes clear that the moral bioenhancement debate is misguided. (shrink)

Discussions about genetic testing are used to exemplify how they might be doing so. Quite often bioethicists use clinical cases to support particular moral obligations or rights as if these cases were representative of the kind of information we can acquire about human diseases through genetic testing, when they are not. On other occasions, the clinical cases are presented (...) in simplistic ways that portray genetic testing as yielding information more accurate than it actually is. It is concluded that, because of the problematic implications that the ideology of genetic determinism might have for individuals’ wellbeing and for our public policies, bioethicists should be careful to present these issues in ways that do not promote questionable ideas about the causal role of genes in human diseases and behaviours. The lack of public support for climate change policies and refusals to vaccinate children are just two alarming illustrations of the impacts of dissent about scientific claims. Dissent can lead to confusion, false beliefs, and widespread public doubt about highly justified scientific evidence. Even more dangerously, it has begun to corrode the very authority of scientific consensus and knowledge. Deployed aggressively and to political ends, some dissent can intimidate scientists, stymie research, and lead both the public and policymakers to oppose (...) important public policies firmly rooted in science. -/- To criticize dissent is, however, a fraught exercise. Skepticism and fearless debate are key to the scientific process, making it both vital and incredibly difficult to characterize and identify dissent that is problematic in its approach and consequences. Indeed, as de Melo-Martín and Intemann show, the criteria commonly proposed as means of identifying inappropriate dissent are flawed and the strategies generally recommended to tackle such dissent are not only ineffective but could even make the situation worse. -/- The Fight Against Doubt proposes that progress on this front can best be achieved by enhancing the trustworthiness of the scientific community and by being more realistic about the limits of science when it comes to policymaking. It shows that a richer understanding of the context in which science operates is needed to disarm problematic dissent and those who deploy it. This, the authors argue, is the best way forward, rather than diagnosing the many instances of wrong-headed dissent. (shrink)

The U.S. Food and Drug Administration (FDA) announced recently that food products derived from some animal clones and their offspring are safe for human consumption. In response to criticism that it had failed to engage with ethical, social, and economic concerns raised by livestock cloning, the FDA argued that addressing normative issues prior to issuing a final ruling on animal cloning is not part of its mission. In this article, the authors reject the FDA's claim that its mission to protect (...) and advance public health can be accomplished without considering ethical issues or without making value judgments. The authors offer two arguments in support of their position. First, the agency's mission statement presupposes significant normative commitments and judgments. Second, the FDA's risk assessment of food products from cloned animals and their offspring is itself clearly shaped by a variety of normative commitments. (shrink)

The use of genome embryo editing tools in reproduction is often touted as a way to ensure the birth of healthy and genetically related children. Many would agree that this is a worthy goal. The purpose of this paper is to argue that, if we are concerned with justice, accepting such goal as morally appropriate commits one to rejecting the development of embryo editing for reproductive purposes. Despite increasing recognition of the ways in which ethical and social values play a role in science (Kitcher 2001; Longino 1990, 2002), scientists are often still reluctant to acknowledge or discuss ethical and social values at stake in their research. Even when research is closely connected to developing public policy, it is generally held that it should be empirical data, and not the values of scientists, that inform policy. According to this view, scientists need not, and should not, endorse non-epistemic (...) values related to their research, as doing so may bias their assessment of what the evidence is. A growing number of jurisdictions hold that gamete donors must be identifiable to the children born with their eggs or sperm, on grounds that being able to know about one's genetic origins is a fundamental moral right. But the argument for that belief has not yet been adequately made.

Discussions about whether new biomedical technologies threaten or violate human dignity are now common. Indeed, appeals to human dignity have played a central role in national and international debates about whether to allow particular kinds of biomedical investigations. The focus of this paper is on chimera research. I argue here that both those who claim that particular types of human-nonhuman chimera research threaten human dignity and those who argue that such threat does not exist fail to make their case. I (...) first introduce some of the arguments that have been offered supporting the claim that the creation of certain sorts of chimeras threatens or violates human dignity. I next present opponents' assessments of such arguments. Finally I critically analyze both the critics' and the supporters' claims about whether chimera research threatens human dignity. (shrink)

While various definitions of moral distress have been proposed, some agreement exists that it results from illegitimate constraints in clinical practice affecting healthcare professionals’ moral agency. If we are to reduce moral distress, instruments measuring it should provide relevant information about such illegitimate constraints. Unfortunately, existing instruments fail to do so. We discuss here several shortcomings of major instruments in use: their inability to determine whether reports of moral distress involve an accurate assessment of the requisite clinical and logistical facts (...) in play, whether the distress in question is aptly characterized as moral, and whether the moral distress reported is an appropriate target of elimination. Such failures seriously limit the ability of empirical work on moral distress to foster appropriate change. (shrink)

Proponents of moral enhancement believe that we should pursue and apply biotechnological means to morally enhance human beings, as failing to do so is likely to lead to humanity's demise. Unsurprisingly, these proposals have generated a substantial amount of debate about the moral permissibility of using such interventions. Here I put aside concerns about the permissibility of moral enhancement and focus on the conceptual and evidentiary grounds for the moral enhancement project. I argue that such grounds are quite precarious.

According to sparse modalism, the notion of essence can be analysed in terms of necessity and naturalness. In this paper, I develop and defend a version of sparse modalism that is equipped with a non-standard, relativized conception of naturalness. According to this conception, properties and relations can be natural to different degrees relative to different kinds of things, and relations can be natural to different degrees relative to different slots. I argue that this relativized version of sparse modalism can accommodate (...) various cases that the standard, non-relativized version can’t. The alternative version can accommodate cases where a relation is essential to a relatum but merely necessary to another, cases where a property is essential to an object but merely necessary to another, and cases where a less-than-perfectly natural property is essential to an object. Recent advances in biotechnologies have led to speculations about enhancing human beings. Many of the moral arguments presented to defend human enhancement technologies have been limited to discussions of their risks and benefits. The author argues that in so far as ethical arguments focus primarily on risks and benefits of human enhancement technologies, these arguments will be insufficient to provide a robust defence of these technologies. This is so because the belief that an assessment of risks and benefits is a (...) sufficient ethical evaluation of these technologies incorrectly presupposes that risk assessments do not involve value judgements. Second, it presupposes a reductionist conception of ethics as merely a risk management instrument. Each of these assumptions separates ethical evaluation from discussion and appraisal of ends and means and thus leaves important—indeed, essential—ethical considerations out of view. Once these problematic assumptions are rejected, it becomes clear that an adequate defence of human enhancement technologies requires more than a simple balance of their risks and benefits. (shrink)

ABSTRACT The purpose of this paper is to examine critically Julian Savulescu's claim that people should select, of the possible children they could have, the one who is expected to have the best life, or at least as good a life as the others, based on the relevant, available genetic information, including information about non‐disease genes. I argue here that in defending this moral obligation, Savulescu has neglected several important issues such as access to selection technologies, disproportionate burdens on women, (...) difficulties in determining what is best, problems with aggregate effects of individual choices, and questions about social justice. Reprogenetic technologies, which combine the power of reproductive techniques with the tools of genetic science and technology, promise prospective parents a remarkable degree of control to pick and choose the likely characteristics of their offspring. Not only can they select embryos with or without particular genetically-related diseases and disabilities but also choose embryos with non-disease related traits such as sex. -/- Prominent authors such as Agar, Buchanan, DeGrazia, Green, Harris, Robertson, Savulescu, and Silver have flocked to the banner of reprogenetics. They advocate use of these technologies to create beings who enjoy longer and healthier lives, possess greater intellectual capacities, and are capable of more refined emotional experiences. Indeed, Harris and Savulescu in particular take reprogenetic technologies to be so valuable to human beings that they have insisted that their use is not only morally permissible but morally required. -/- Rethinking Reprogenetics challenges this mainstream view with a contextualised, gender-attentive philosophical perspective. De Melo-Martín demonstrates that you do not have to be a Luddite, social conservative, or religious zealot to resist the siren song of reprogenetics. Pointing out the flawed nature of the arguments put forward by the technologies' proponents, Rethinking Reprogenetics reveals the problematic nature of the assumptions underpinning current evaluations of these technologies and offers a framework for a more critical and skeptical assessment. The growing commercialization of scientific research has raised important concerns about industry bias. According to some evidence, so-called industry bias can affect the integrity of the science as well as the direction of the research agenda. I argue that conceptualizing industry’s influence in scientific research in terms of bias is unhelpful. Insofar as industry sponsorship negatively affects the integrity of the research, it does so through biasing mechanisms that can affect any research independently of the source of funding. Talk about (...) industry bias thus offers no insight into the particular epistemic shortcomings at stake. If the concern is with the negative effects that industry funding can have on the research agenda, conceptualizing this influence as bias obscures the ways in which such impact is problematic and limits our ability to offer solutions that can successfully address the concerns raised by the growing role of private funding in science. Leibniz’s De incerti aestimatione, which contains his solution to the division problem, has not received much attention, let alone much appreciation. This is surprising because it is in this work that the definition of probability in terms of equally possible cases appears for the first time. The division problem is used to establish and test probability theory; it can be stated as follows: if two players agree to play a game in which one has to win a certain number of (...) rounds in order to win the pool, but if they break the game off before either of them has won the required number of rounds, how should the pool be distributed?Our article has two aims: it provides the readers with the first published English translation of De incerti aestimatione, and it also gives them a brief commentary that explains Leibniz’s philosophical and mathematical concepts necessary in order to understand this work. The translation is as literal as possible throughout; it shows how Leibniz struggled at times to find a solution to the division problem and how he approached it from different angles. The commentary discusses Leibniz’s views on four key concepts: fairness, hope, authority and possibility. The commentary then outlines how Leibniz attempted to solve the problem of division. (shrink)
